Responding to Office Actions
If you have received an Office Action from the United States Patent and Trademark Office and would like us to prepare and file the response to the Office Action, please call us at 1-800-718-7924 or email us at info@ustrademarkservices.com and provide your Serial Number (application number). Once we have the chance to review the Office Action, we can provide you with an estimate of the time/cost needed to prepare the response.

When the trademark office issues an Office Action, they are raising an objection to your application. There are typically two general categories of objections to an application. A procedural objection typically relates to form and includes such things as the goods/service are classified in more than the class listed on the application; or part of your mark is considered generic and you are requested to disclaim exclusive rights to a part of your mark. A substantive objection typically means that the trademark office is objecting to your attempt to register your mark on the basis that the mark is confusingly similar to a mark that has already been registered or which was filed before your application. Filing Pre-Registration Documents
If you receive a Notice of Allowance from the United States Patent and Trademark Office and would like us to assist you in preparing either the Statement of Use (to be filed once you have started to use your mark in commerce) or a request for extension of time to start using your mark, please call us at 1-800-718-7924 or email us at info@ustrademarkservices.com and provide your Serial Number (application number). We charge a flat fee rate of $100.00, per trademark class, to prepare and file the Statement of Use or a Request for An Extension of Time to File a Statement of Use. Note that this professional service fee is in addition to the applicable government filing fees.

Filing Post-Registration Documents
Now that your mark is registered, you need to make the necessary post-registration filings in order to keep the registration in effect. Between the fifth and sixth years after the trademark registration date, the trademark owner must file a Declaration of Use and pay the corresponding fee. Then, between the ninth and tenth years after the trademark registration date, the trademark owner must file a Combined Declaration of Use/Application for Renewal, and pay the corresponding fee. Failure to make the appropriate filings on a timely basis will result in the registration being cancelled. We charge a flat fee rate of $100.00, per trademark class, to prepare and file a Declaration of Use or a Combined Declaration of Use/Application for Renewal.
